Event Summary :

The objective of the seminar was to find ways to effective and expeditious disposal of high value commercial dispute in India. This topic has become relevant today because one of the reasons for the hesitation of foreign investors to invest in India is the delay in our justice delivery system. To avoid such delays in commercial disputes the government of India adapt Arbitration and Conciliation Act, 1996 in similar lines of UNICITRAL Model arbitration law, but still the courts of India do not hesitate to interfere under S.34 which is an appeal provision in the Act.

In the above said National Conference the managing partner of Law Senate Law Firm, Mr. S. Ravi Shankar, was an invited speaker. During his presentation he stated that till the pendency in the courts of India is reduced the entire commercial dispute will also get delayed. He also stated that as on 1st January,

  • 34 lakh cases are pending in the 23 High Courts of India.
  • 60,000 cases are pending in the Supreme Court of India.
  • The oldest pending cases in Delhi High court is 20 years old.
  • The high Court of Bombay has 3.4 lakh pending cases.

He further shared to the audience that the judges, people ratio in India is 10 judges per 10 lakh people and in USA it is 100. He also stated that Law commission and Supreme Court of India gave recommendations to government of India directing for the appointment of maximum of 50 judges per 10 lakh people. He further stated that the budget allotted to ministry of law and justice is less than 1% of the total budget of India.
