Any Prospective Parent Could Adopt a Child said Apex Court

The issue (Shabnam Hashmi V. UOI) of common adoption of children irrespective of religion, race or class came before the apex court in the above writ petition wherein the petitioner sought for guidelines for the same and also sought the apex court to issue direction to union of India to enact an optional law with the prime focus of which the child with considerations like religion taking a hind seat.

The court discussed adoption procedure and law in India and introduction of definition of adoption definition in Juvenile Justice Act 2000 by amendment to act. The Court also said Muslim law do not recognise adoption and said that by virtue of Juvenile Justice Act, any prospective parent could adopt a child as per the provisions of the Act, rules and guidelines of Central adoption resource agency and this was in fact a step in this direction of common adoption procedure. The court also said that personal beliefs and faith must be honoured but cannot be allowed to dictate the operation of the provision of the Juvenile Justice act. The Court however refrained from giving any directions as enacting of uniform law in respect to adoption.
