Supreme Court Refuses To Pause KG Basin Gas Dispute Hearing

The Supreme Court recently refused to halt proceedings in the long-running Krishna-Godavari Basin gas dispute involving Reliance Industries, its foreign consortium partners, and the Union government, despite submissions regarding possible mediation between the parties.

During the hearing, Reliance Industries argued that the dispute carries the character of an international commercial arbitration because foreign companies, including BP Exploration and Niko Resources, are part of the consortium operating the KG-D6 block. It was further submitted that the project, investments, and arbitration proceedings were undertaken collectively by all consortium partners under the production sharing agreement.

The dispute originates from allegations that natural gas migrated from ONGC-operated fields into adjoining blocks where extraction was carried out by the consortium. Earlier arbitral proceedings had reportedly ruled in favour of Reliance and its partners. However, the Delhi High Court later set aside the arbitral award, which eventually led the matter before the Supreme Court.

The proceedings continue to remain significant because the outcome may impact India’s energy sector, large-scale production sharing contracts, foreign investment confidence, and the broader interpretation of international arbitration principles in commercial disputes involving multinational entities.
