XYZ, an incorporated USA based Company wanted to start a Joint venture Company in India to start a BPO to do their back office work from India. They came to that decision because they were advised that, to start a venture of a Foreign Company in India, an Indian partner is necessary. But we advised them that a Foreign Company does not require any partner to start a branch office, if the field of operation comes under the automatic route and if the Foreign Company qualify certain conditions prescribed by Government. XYZ Company was ready to invest 1,00,000 USD as paid up capital and had a profit making track record for more than 5 years. Since XYZ is not going to have any revenue from their Indian venture there is no tax implication also. Now the branch office of the USA Company is opened in India with all required approvals.
